The Australian International Trade Commission (AITC) has turned down the Trump administration’s appeal against a ruling that declared President Donald Trump’s proposed solar-power tariffs illegal, and Australia is now free to retaliate.
“On the basis of the unprecedented procedural mistakes committed by the USTR, the panel considered whether the USTR has shown that their proposed duties are reasonable,” according to a statement from AITC chairman Jennifer Williams. “The panel did not find that it had been demonstrated that the duties are reasonable.”
The tariff on solar-power products first came under threat in May, when an estimated 1,000 companies and organizations filed an original complaint against the President’s proposed safeguard tariffs. The complaint, brought by the Coalition for Affordable Solar Energy, described the tariff as “extraordinary, unwarranted and unlawful.”
On June 25, a U.S. International Trade Commission (USITC) panel found that the President’s safeguard tariffs are unnecessary, and ordered that they be removed. The Committee at the time also instructed that once a safeguard order was removed, any legal challenges to it would be determined in federal district court by Judge Christopher B. Conlogue.
AITC has always been curious to learn what it has termed an “alternative argument” in favor of the tariffs. It issued a mandate on September 5, to gather evidence regarding the “enforcement of U.S. trade law to protect the U.S. solar trade interest” and heard oral arguments from the Trump administration and the Coalition for Affordable Solar Energy on October 3. AUS Trade Partners Inc., which also raised objections to the tariffs, supported the Coalition’s arguments.
The Trump administration’s opening arguments for the tariff failed to account for the fact that foreign trade constitutes a privilege, not a right, and that Congress did not have the authority to appropriate state and local governments to enforce its laws in the federal territory.
