W.Va. Senate passes 1st gun control bill since 2012

West Virginia has one of the highest rates of gun violence in the nation, and the state’s Supreme Court could soon make it even worse.

A proposed amendment to West Virginia’s Constitution, S.J. Resolution 1, would expand gun rights, and opponents of the resolution say it would undermine the mental health system.

The resolution would remove the ability of state courts to grant petitions to allow individuals to appeal their criminal convictions. Those individuals would then have their criminal convictions appealed to the state Supreme Court, and it is not clear if the resolution would allow their appeals to be granted.

The resolution also does not expand the due process rights of the accused; it specifically stipulates that “the rights of an accused in a criminal prosecution shall not be expanded to include any right to use any form of gun or firearm to defend oneself.”

Opponents of the resolution said it is meant to hinder the prosecution of those individuals who were convicted of crimes using guns in the commission of their crimes.

The West Virginia House of Delegates passed the resolution, S.J. Resolution 1, on Jan. 24, by a vote of 45-18. It is expected to be passed by the Senate in the coming weeks.

Jeff Morley, executive director of the West Virginia chapter of the National Alliance on Mental Illness, said the measure would make it more difficult for those who are mentally ill to be prosecuted for crimes committed with guns.

“It would make it easier for someone to get a gun because there would be no criminal charges filed against that person if they’re deemed by the judge to be mentally ill,” Morley said. “This will make it easier for individuals who are mentally ill to go out and buy guns.”

Morley also said the resolution would prevent prosecutors from filing charges against individuals who are mentally ill.
